1. LEGAL INFORMATION AND ACCEPTANCE
These provisions regulate the use of the Santiago Bernabéu Stadium website www.bernabeu.realmadrid.com (hereinafter, the "Website") that REAL MADRID ESTADIO, S.L.U. (hereinafter, "REAL MADRID ESTADIO ") makes available to Internet users.
REAL MADRID ESTADIO, S.L.U., with registered office at Avenida de Concha Espina, nº 1, Madrid, Spain, and C.I.F. number B 16827172 is registered in the Mercantile Register of Madrid, Volume 42423, folio 56, page M750793.
Access to the Website is free of charge. Access to and use of the Website confers the status of user of the Website (hereinafter, the "User") and implies acceptance of all the conditions included in this Legal Notice as well as its modifications.
The provision of the Website service is limited to the time at which the User is connected to the Website or to any of the services provided through it. Therefore, the User must read this Legal Notice carefully each time he/she intends to use the Website, as the Website and its conditions of use set out in this Legal Notice may be subject to change.
The Website complies with the regulations corresponding to its address in Spain. REAL MADRID ESTADIO does not ensure that the Website complies with the legislation of other countries, either totally or partially. If the User resides or is domiciled in any other place and decides to access and/or use this Website, he/she does so under his/her own responsibility and risk and must ensure that such access and/or use complies with the applicable local legislation, and REAL MADRID ESTADIO does not assume any liability that may arise from such access.
2. INTELLECTUAL AND INDUSTRIAL PROPERTY
All content and/or any other elements of the Website, including but not limited to texts, trademarks, photographs, graphics, images, icons, technology, software, links and other audiovisual or sound content, as well as its graphic design and source codes (hereinafter, The "Contents"), are the property of REAL MADRID ESTADIO or third parties, and none of the exploitation rights recognised by the current intellectual property legislation on the same may be understood to have been transferred to the User, except for those that are strictly necessary for the use of the Website.
The trademarks, trade names or distinctive signs are owned by REAL MADRID ESTADIO or third parties, and access to the Website shall not be construed as attributing any right over the aforementioned trademarks, trade names and/or distinctive signs.
Pursuant to the provisions of Royal Legislative Decree 1/1996, of 12 April, which approves the Revised Text of the Intellectual Property Law, regularising, clarifying and harmonising the legal provisions in force on the matter, the reproduction, distribution and public communication, including making available, of all or part of the Contents, for commercial purposes, on any support and by any technical means, are expressly prohibited without the express written authorisation of REAL MADRID STADIUM or the third party holder of the rights in question.
The User undertakes to respect the intellectual and industrial property rights owned by REAL MADRID ESTADIO and/or third parties.
3. TERMS OF USE OF THE WEBSITE
3.1 General
The User acknowledges and accepts that access to and use of the Website takes place freely and consciously, under his/her sole responsibility.
The User undertakes to make correct and lawful use of the Website in accordance with the Law, this Legal Notice, good faith and public order. The User will be liable to REAL MADRID ESTADIO or third parties for any damages that may be caused as a result of non-compliance with this obligation.
It is expressly forbidden to use the Website for purposes harmful to the property or interests of REAL MADRID ESTADIO or third parties or that in any other way overload, damage or render useless the networks, servers and other computer equipment (hardware) or computer products and applications (software) of REAL MADRID ESTADIO or third parties.
The following actions are also prohibited:
- The use of computer viruses or any other code, file or program that is designed or intended to interrupt, damage, or limit the operation of any software, hardware or telecommunications equipment, or damage or gain unauthorised access to data or other information of REAL MADRID ESTADIO or any third party.
- Impersonate, interfere with or disrupt the service, servers or networks connected to the services or fail to comply with the requirements, procedures, policies or regulations of networks connected to the services.
- Use automated scripts or screen scraping to collect information or interact with REAL MADRID ESTADIO.
- Retrieve data systematically or from other REAL MADRID ESTADIO content to create, directly or indirectly, in individual or multiple downloads, a collection of data, either manually or by means of bots, crawlers or similar. Access, manipulate or use non-public areas of the Website, REAL MADRID ESTADIO's computer systems or its suppliers' systems.
- Any attempt to test the vulnerability of any REAL MADRID ESTADIO system or network or to breach any security or authentication measures.
- Falsify or alter any REAL MADRID ESTADIO information.
- Attempting to decipher, decompile, disassemble REAL MADRID ESTADIO or third party software.
- Delete, hide or manipulate the copyright notes and other data identifying REAL MADRID ESTADIO or third parties included in the Contents, as well as the technical protection devices or any other information mechanisms that may be included in the Contents.
- Collaborating with a third party in carrying out any of the conduct described above.
3.2 Contents
The User undertakes to use the Contents in accordance with the Law, this Legal Notice, good faith and public order, as well as with the other conditions, regulations and instructions that may be applicable in accordance with the provisions of Clause One.
By way of example, the User, in accordance with current legislation, must abstain from:
a) Reproduce, copy, distribute, make available, publicly communicate, transform or modify the Contents except in the cases authorised by Law or expressly consented to by REAL MADRID ESTADIO in writing or by whoever holds the ownership of the exploitation rights, as the case may be.
b) Reproduce or copy for private use the Contents that may be considered as software or database in accordance with current legislation on intellectual property, as well as their public communication or making them available to third parties when these acts necessarily imply reproduction by the User or a third party.
c) Extract and/or reuse all or a substantial part of the Contents of the Website as well as the databases that REAL MADRID ESTADIO makes available to Users.
d) Obtain or attempt to obtain the Contents using means or procedures other than those which, as the case may be, have been made available for this purpose or which have been expressly indicated on the Website or, in general, those which are normally used on the Internet because they do not entail a risk of damage or disablement of the Website and/or the Services.
3.3 Introduction of links to the website
Users who wish to introduce links from their own web pages to the Website must comply with the conditions detailed below, and ignorance of these conditions shall not prevent the responsibilities derived from the Law:
a) The link will only link to the home page or main page of the Website but may not reproduce it in any form (inline links, copy of texts, graphics, etc.).
b) It shall be prohibited in all cases, in accordance with the applicable legislation in force from time to time, to establish frames of any kind that surround the Website or allow the Contents to be viewed through Internet addresses other than those of the Website and, in any case, when they are displayed together with contents outside the Website in such a way that: (i) produces, or may produce, error, confusion or deception in Users about the true origin of the service or Contents; (ii) involves an act of unfair comparison or imitation; (iii) serves to take advantage of the reputation of the brand and prestige of REAL MADRID ESTADIO; or (iv) in any other way is prohibited by current legislation.
c) The page that introduces the link will not make any false, inaccurate or incorrect statement about REAL MADRID ESTADIO, its directors, partners, employees, clients or about the quality of the services it provides.
d) Under no circumstances will it be stated on the page where the link is located that REAL MADRID ESTADIO has given its consent for the insertion of the link or that it otherwise sponsors, collaborates, verifies or supervises the services of the sender.
e) The use of any word, graphic or mixed brand or any other distinctive sign of REAL MADRID ESTADIO within the sender's page is prohibited except in cases permitted by law or expressly authorised by REAL MADRID ESTADIO in writing and provided that, in these cases, a direct link to the Website is permitted in the manner established in this Clause.
f) The page that establishes the link must faithfully comply with the Law and may not under any circumstances provide or link to its own or third party content that: (i) is illicit, harmful or contrary to morals and good customs (pornographic, violent, racist, etc.); (ii) induces or may induce the User to falsely believe that REAL MADRID ESTADIO subscribes to, endorses, adheres to or in any way supports the ideas, statements or expressions of REAL MADRID ESTADIO.); (ii) induce or may induce in the User the false conception that REAL MADRID ESTADIO subscribes to, endorses, adheres to or in any way supports the ideas, statements or expressions, legal or illegal, of the sender; (iii) are inappropriate or not relevant to the activity of REAL MADRID ESTADIO in view of the place, contents and theme of the sender's website.
4. EXCLUSION OF LIABILITY
4.1 Information
The User accepts that REAL MADRID ESTADIO assumes no responsibility for the delay, deletion, misdelivery, or failure to save User communications or personal settings.
REAL MADRID ESTADIO is not responsible for the decisions taken based on the information provided on the Website nor for the damages caused to the User or third parties as a result of actions based solely on the information obtained on the Website.
4.2 Quality of service
We reserve the right to refuse to provide the service to anyone for any reason and/or to discontinue the service in whole or in part at any time, with or without notice.
The use of the Website is subject to all applicable regulations and the User shall be solely responsible for the content of his or her communications through the Website.
Access to the Website does not imply any obligation on the part of REAL MADRID ESTADIO to control the absence of viruses or any other harmful computer element. In any case, the User is responsible for the availability of adequate tools for the detection and disinfection of harmful computer programmes.
REAL MADRID ESTADIO is not responsible for any damage caused to Users' or third parties' computer equipment during the provision of the Website service.
REAL MADRID ESTADIO does not grant any guarantee and is not responsible, in any case, for damages of any nature that may arise from the access or use of the Contents or the Website. Among others, REAL MADRID ESTADIO is not responsible for the following circumstances:
- the lack of maintenance and effective functioning of the Website and/or its services or Contents.
- lack of usefulness of the Website or the Contents for any activity.
- the existence of viruses, malicious or harmful programmes in the Contents.
- the reception, obtaining, storage, dissemination or transmission by Users of the Content.
- the illicit, negligent, fraudulent use, contrary to the terms of this Legal Notice, or to good faith and public order, of the Website or its Contents, on the part of the Users.
4.3 Service availability
Access to the Website requires services and supplies from third parties, including transport through telecommunications networks whose reliability, quality, continuity and operation does not correspond to REAL MADRID ESTADIO. Therefore, the services provided through the Website may be suspended, cancelled or become inaccessible, prior to or simultaneously with the provision of the Website service.
REAL MADRID ESTADIO is not responsible for damages of any kind caused to the User as a result of failures or disconnections in telecommunications networks, computer failures or other electronic systems that cause the suspension, cancellation or interruption of the Website service during or prior to the provision of the same.
4.4 Content and services linked through the Website
The Website access service includes technical linking devices, directories and even search tools that allow the User to access other web pages (hereinafter, "Linked Sites"). In these cases, REAL MADRID ESTADIO acts as an intermediary service provider in accordance with article 17 of Law 34/2002, of 12 July, on Information Society Services and Electronic Commerce ("LSSI") and will only be responsible for the contents and services provided on the Linked Sites to the extent that it has effective knowledge of the unlawfulness and has not deactivated the link with due diligence.
Under no circumstances should the existence of Linked Sites presuppose the existence of agreements with the managers or owners of the same, nor the recommendation, promotion or identification of REAL MADRID ESTADIO with the statements, content or services provided. The Linked Sites are provided for reference purposes only.
Although REAL MADRID ESTADIO only provides links to websites that to the best of its knowledge and belief comply with the applicable legislation, REAL MADRID ESTADIO does not know or approve the contents and services of the Linked Sites and therefore is not responsible for damages caused by the unlawfulness, quality, outdatedness, unavailability, error and uselessness of the contents and/or services of the Linked Sites or for any other damage that is not directly attributable to REAL MADRID ESTADIO.
We reserve the right to remove or block access to such content on suspicion that it may be unlawful or injure property or rights of third parties liable for compensation and of course in those cases in which we have actual knowledge of it, either by court order, administrative order or by any other means.
5. DURATION AND MODIFICATION
The conditions of this Legal Notice will remain in force until they are modified, and REAL MADRID ESTADIO may make these changes, which will be communicated to the User.
REAL MADRID ESTADIO may delete, add or change both the Contents and the services it provides, as well as the way in which they are located or presented. The conditions published at the time the User accesses the Website are understood to be in force. REAL MADRID ESTADIO invites you to consult this Legal Notice periodically.
6. COMPETENT LAW AND JURISDICTION
This Legal Notice is governed in each and every one of its aspects by Spanish law for the resolution of any dispute in relation to this Legal Notice or the relationship between them.
